The California Lemon Law Claim Process

If you’re considering a claim, you probably want to know what you’re walking into. Here’s the honest answer: it moves through five clear stages, and you should know what each one means before you commit to anything.

Before You Start

Five Stages, Start to Finish

A lemon law claim isn’t a mystery. From the first look at your repair records to a courtroom if it comes to that, every case follows the same path. We handle each stage so you don’t have to face the manufacturer alone.

The single most important thing you can do at any point is keep every repair order from every dealership visit. Those records are what prove your case.

The Five Stages of a Claim

01

We Confirm Your Vehicle Qualifies

We check whether the manufacturer has had enough chances to fix the same warranty-covered problem and failed, and whether it affects use, value, or safety.

02

An Honest Consultation

Before you sign anything, we tell you in writing whether your case is strong or weak, what your records prove, and what you’re realistically entitled to recover.

03

We Send a Demand Letter

We send the manufacturer a formal letter citing your repair history, naming the remedy you’re owed, and starting the clock. This becomes the written record if the case goes to court.

04

Settlement Negotiations

Most manufacturers respond with an offer. We push back on low offers, miscalculated mileage credits, and missing incidental costs. Manufacturers know which firms can litigate.

05

We Go to Court If We Have To

If they won’t offer what the law requires, we file suit, run discovery, retain experts, and go to trial. We can afford to fight, and that changes the math.

What to Bring to a Consultation

To get the most out of your first conversation, gather what you can. Don’t wait until you have everything, though, we can help you fill the gaps.

Every Repair Order. From every dealership visit. This is the single most important document.

Purchase or Lease Contract. The agreement you signed when you got the vehicle.

Vehicle Registration. Current registration for the vehicle in question.

A Valid Driver’s License. For identity and standing.

Written Communication. Any emails or letters with the manufacturer about the problem.

Diagnostic Reports. If a shop gave you any, bring them along.

No Cost to You

Attorney Fees Throughout the Process

If you’re working with a Margarian Law attorney and your vehicle qualifies, attorney fees are paid separately by the manufacturer upon a successful outcome, not by you. This holds at every stage, from the first demand letter through trial if necessary.

Filing fees, expert witness costs, and other litigation expenses are real costs the firm absorbs in qualifying cases. We can afford to fight, and manufacturers know it.

Frequently Asked Questions

It varies based on the manufacturer, the defect, your repair history, and whether the case resolves in negotiation or goes to court. An attorney who promises a specific timeline is telling you what you want to hear. We give you a straight, honest assessment based on your case.

Repair orders for every visit, the purchase or lease contract, registration, and a valid driver’s license. Reach out before you have everything, we can help you figure out what’s missing.

A formal letter to the manufacturer stating what the law says you’re owed and giving them a deadline to respond. It’s how the claim formally starts, and it creates the written record that matters if the case goes to court.

Most cases resolve before reaching court. The ones that go typically involve manufacturers who refuse to offer what the law requires. Either way, we’re prepared, and manufacturers know that.

You can, but most consumers don’t. The math is technical, manufacturers know who will push back, and the law makes the manufacturer pay your attorney fees on a successful outcome. Representation costs you nothing on a qualifying case and changes what ends up on the table.

Cases are reviewed individually before anything is signed, so you know what you’re walking into. If a case is weak, we say so first. The specific consequences of an unsuccessful outcome are spelled out in writing in the retainer.
