Class Action Litigation

Class action litigation is a tool which allows a consumer to file a claim both on one’s own behalf and on behalf of all those similarly situated. This creates the means for that one individual to represent the 10 or 100 or 1000 or tens of thousands of individuals who are similarly affected. The benefit of filing a class action claim is the fact that is saves judicial resources and one judge rather than multiple judges render a decision about the same situation.

Another benefit of filing a class action lawsuit is the fact that it saves on litigation costs. The thing is that one individual’s claim might be worth $5,000 or $10,000, $20,000 or perhaps $30,000, we all know that a litigation is very costly, therefore if that one individual files his/her claim as an individual claim he/she may end up spending $10,000, $20,000 or even $30,000 on litigation expenses and it might not be effective or prudent to file that claim because the fees might outweigh the expected benefit from the case.

However, in a class action litigation scenario, for example if there are 1,000 individuals who are affected by the same circumstances or events, and if each of the individuals has a certain claim costing a certain amount of money, by filing a class action lawsuit it becomes possible for that individual’s claim to be heard and for that individual to receive compensation based on the merits of his/her claim. It also allows that individual to step forward and help the class as a group. As a result of being the class representative, the individual may also qualify to receive an enhancement. An enhancement is received in the event that the individual contributes time and effort in assisting the attorney and a court to make a determination in the case. The amount of the enhancement varies; it depends on the size of the case, the size of the benefit ultimately received on behalf of the entire class.
