Class Action Lawsuits and Information Available to the Public

Have you been harmed by a defective product? Do you know others with the same or similar injuries caused by the same product? Do you know that class action lawsuits can help you get compensation?

And the last question (I promise!) Did you answer “Yes” to the first two questions and “No” to the other? Well, here’s your chance to find out how to benefit from class action lawsuits! Let’s go!

What is a Class Action?

A class action is a lawsuit in which a large number of people who’ve suffered the same or similar injuries sue another party. If the lead plaintiff proves that all class members have similar claims, the judge will certify the class.

These cases may involve consumers who purchased defective products, people who are the victims of race discrimination in the workplace, patients who had used drugs that caused serious side effects, etc.

Is Getting Involved with the Class Action Lawsuit Worth it?

“If everyone is moving forward together, then success takes care of itself.” – Henry Ford

I’m sure Henry Ford didn’t think of class action lawsuits when he expressed this truly wonderful idea, but class action is also about moving forward together towards a collective goal.

So, the number one benefit of a class action lawsuit is that class members stand stronger together and increase their chances to win the case!

How Are Class Members Notified?

Once the class action is certified, the potential plaintiffs of the class are notified of the existence of the class action. This is typically done via email, general media such as television, an advertisement, or a posted flyer.

Each member of the class has the right to (1) remain part of the class, or (2) “opt out” of the class action lawsuit.

Those who remain part of the class will receive some payment if the class of plaintiffs wins. Does this mean class members will get rich? Absolutely not! Remember, settlements may be worth millions, but your share may not even fully cover damages.

Class members won’t be able to file new or individual lawsuits over the same issue against the same defendant.

On the flip side, if the class member decides not to participate as a member of the class, he or she will receive no benefit from the class-action lawsuit but can file an individual lawsuit.
