The case

Active Distance Assist kept failing — radar software, a new steering column module, camera recalibrations and phantom braking across nine visits

Our client leased a new 2024 Mercedes-Benz C300. At about 9,000 miles, an 'Active Distance Assist inoperative' warning appeared, and the steering-assist function stopped working.

The dealer updated software on both rear radar sensors, then replaced the steering column module after finding an electrical fault in the steering-wheel electronics. The warnings kept returning: traction control, Active Brake Assist, Distance Assist. The dealer updated and recalibrated the brake-control software and the multifunction camera. Our client also reported phantom braking, and the dealer found multiple camera fault codes. The last visit found power-steering module communication faults.

The turning point

Why the manufacturer paid

The driver-assistance and braking systems are safety systems. When the same safety feature keeps failing after repeated repairs, the manufacturer has had its reasonable number of attempts.

The result

How it ended

Mercedes-Benz repurchased the C300 and paid off the $42,114.35 lease balance. Our client received $15,765.54: $14,250.94 in statutory damages plus $1,514.61 in civil penalties/additional recovery.

What this case shows

Recurring safety-system warnings aren't minor. Driver-assist and braking failures can support a lemon law claim.
