The case

AMG air suspension failed twice — ‘Max 50 mph’ warnings, the SUV sitting on the ground, towed in both times

Our client bought a new 2023 Mercedes-AMG GLE 53 with $30,000 down. At 9,890 miles it was towed in with the check engine, ABS and traction control lights on and an 'Active Brake Assist inoperative' warning.

A loose harness pin had damaged the left front wheel speed sensor. The bigger problem came next: a warning not to exceed 50 mph, with the SUV sitting very low. It was towed in again, and the dealer found an electrical fault in the air suspension system and replaced a level sensor. Months later the 'Max speed 50 mph' warning returned, the suspension went rigid, and the dealer found a damaged connector housing at the AMG Ride Control unit, along with a coolant-level fault.

The turning point

Why the manufacturer paid

A suspension system that limits a performance SUV to 50 mph is a safety defect. When it fails twice, with more than 30 days out of service, the Song-Beverly Act requires the manufacturer to make the owner whole.

The result

How it ended

Mercedes-Benz repurchased the GLE 53 and paid off the $35,190.22 loan. Our client received $74,960.85: the $30,000 down payment and $47,390.20 in monthly payments, less the statutory mileage offset, for $69,811.35 in statutory damages, plus $5,149.50 in civil penalties/additional recovery.
