The case

Engine smoked and shut off while driving — failed fuel injector scored the cylinders; engine AND transmission replaced on one visit

Our client leased a new 2023 Jeep Wrangler 4xe plug-in hybrid. At about 28,900 miles, the engine started smoking while driving, the check engine light came on, and the engine shut off.

The dealer found about a quart of fuel in the engine oil and low compression on every cylinder. A failed fuel injector had scored the cylinder walls, so the entire long block was replaced. During that repair, technicians also found a porous transmission case leaking fluid, and the transmission was replaced as well. A rear differential locker sensor was replaced on the same visit.

The repair record

41 countable days out of service

The first visit lasted 38 consecutive days. Four days after pickup, the Jeep would not start without a jump, and the 12V battery was replaced. That made 41 days out of service across two visits, every one of them countable.

The turning point

Why the manufacturer paid

California law presumes a vehicle is a lemon once it has been out of service 30 or more days for warranty repairs during the presumption period. Because this Jeep's repairs came later in ownership, the case rested on the severity of the failure: a new engine and a new transmission on a vehicle still under warranty.

The result

How it ended

FCA repurchased the Jeep and paid off the $47,227.75 lease balance. Our client received $19,430.78: $18,229.81 in statutory damages plus $1,200.97 in civil penalties/additional recovery.

What this case shows

Higher mileage doesn't disqualify a claim. A catastrophic powertrain failure under warranty can still support a buyback.
