The case

Three verified engine/drivetrain faults, a loss-of-power failure and a jammed seat belt on a new X6

Our client leased a new 2024 BMW X6 xDrive40i. At 2,148 miles the check engine light started going on and off, and over the next 20 months the SUV went back to the dealer six times.

The dealer verified three separate engine and drivetrain faults: rocker-arm / exhaust-camshaft and DSC unit codes, a hybrid pressure-refueling control unit fault, and a failed coolant pump. On another visit, a 'drivetrain malfunction' warning came with reduced engine power, and the auxiliary coolant pump and power distribution box were replaced. A rear seat belt that wouldn't retract was found to have an internal mechanical failure.

The turning point

Why the manufacturer paid

Our client wanted to keep the vehicle. A lemon law claim doesn't always have to end with giving the car back. A cash settlement can compensate the owner for living with the defects.

The result

How it ended

BMW resolved the case with a cash settlement. Our client kept the X6 and received $6,731.50, equal to five monthly lease payments.

What this case shows

A buyback isn't the only outcome. If you want to keep your car, a cash-and-keep settlement may be an option.
